101 the Fox presents Classic Camaros – Then & Now

Official Promotional Rules

A complete copy of these rules can be obtained at the offices of radio station 101 the Fox - KCFX (the “Station”)owned and operated by CMP KC Corp., a wholly owned subsidiary of Cumulus Media Partners LLC, 5800 Foxridge Dr., Mission, KS 66202, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

The Station will conduct the “Classic Camaro – Then and Now” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

1.       No purchase is necessary. Void where prohibited. All federal, state, and local regulations apply.

2.     Contest is open only to legal U.S. residents who are age 21 or older with a valid driver’s license and Social Security number at the time of entry. Employees, agents, representatives, or affiliates of the Station, CMP KC Corp. or Cumulus Media Partners LLC, or Schlitz Beer, Cable Dahmer Chevrolet, Cable-Dahmer of Kansas City, Winstead’s Restaurants, and Platinum Tire Group (collectively, “Promotional Sponsors”), and their immediate family members and household members are not eligible to participate or win. The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others.

3.       An individual may win an on-going contest only once per six-month period unless otherwise specifically stated.  An individual may win other seasonal or one-time contests only once for the duration of the contest.

4.       The contest will begin on May 1, 2009 and will run through June 27, 2009 (the “Contest Period”).

5.       Listeners can register to win the Contest in any one of the following ways:

        On-Air Registration: Listen to the Station for the “Dueling Camaros” cue to call (the revving engines of a 1969 Camaro and a 2010 Camaro), which will be played each day Monday through Fridayduringthe Contest Period in the 8am, 11am, and the 3pm hours. The eleventh (11th) caller to 576-77FX (576-7739), as determined by the Station, will be qualified to win the Grand Prize. Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener winning this Contest may be diminished.

        On-Line Registration: Complete an entry form on the Station’s website at www.101theFox.net. All entries must be received by midnight on June 25, 2009. Late or incomplete entries will be disregarded. Each weekday during the Contest Period, one (1) entrant will be randomly selected by the Station from all entry forms submitted to date to be qualified to win the Grand Prize. Qualifiers will be notified by telephone and/or email.  

        On-Site at Station Registration Events: Complete an entry form at any Station remote broadcast or promotional event occurring during the Contest Period that the Station announces as a Registration Event. All entries must submitted by the deadline announced at the Registration Event; late or incomplete entries will be disregarded. At the conclusion of each Registration Event, one (1) entrant will be randomly selected by the Station from all entry forms submitted during the Registration Event to be qualified to win the Grand Prize. Qualifiers will be notified by telephone and/or email if no longer present at the Registration Event.

        On-Site at Promotional Sponsor Locations: Complete an entry form at any of the Promotional Sponsor locations identified in Section 22 below. All entries must be submitted by midnight on June 21, 2009; late or incomplete entries will be disregarded. On June 24, 2009, five (5) qualifiers from each Promotional Sponsor location will be randomly selected to be qualified to win the Grand Prize. Qualifiers will be notified by telephone and/or email.

        On-Site at the Grand Prize Event: Complete an entry form at the Grand Prize giveaway event from 3pm-4:30pm on June 27, 2009 at Winstead’s On the Plaza, 101 Brush Creek Blvd, Kansas City, MO 64112. All such entries must be submitted by 4:30pm; late or incomplete entries will be disregarded. At 4:45pm, a total of five (5) entrants will be randomly selected by the Station from the entry forms submitted at the Grand Prize event to be qualified to win the Grand Prize. Entrants must be present to qualify.

6.       The Grand Prize Giveaway: The Grand Prize event will take place at 5:30pm onJune 27, 2009 at Winstead’s On the Plaza, 101 Brush Creek Blvd, Kansas City, MO 64112. QUALIFIERS MUST BE PRESENT TO WIN. All Grand Prize qualifiers must check in with Station personnel between 3pm and 5pm and present valid ID. Qualifiers who fail to timely check in at the Grand Prize event will be disqualified from the Contest. Upon check in, each qualifier will randomly draw a number to determine the order in which each qualifier will draw their key. Qualifiers will then line up in number order and each will randomly draw a key. Each qualifier will then use their key to attempt to open a lockbox that contains the keys to the Grand Prize. Only one key will open the lockbox. The person with the winning key will be eligible to win the Grand Prize identified in Section 8 below. If it is determined that the candidate is not eligible to receive the Grand Prize, in the Station’s sole judgment and discretion, another qualifier may be selected for eligibility consultation and this process will continue on until such time as an eligible qualifier is found. In the unlikely event that no qualifier is found to meet the specifications, then the Grand Prize will go un-awarded. In the event of a tie, the winner will be determined by and at the Station’s sole discretion. 

7.       The Bonus Prize Giveaway: If the Grand Prize winner is a registered Fox Fanatic, they will be eligible to win an additional Bonus Prize identified in Section 9 below. The registered Fox Fanatic must be registered in the Station’s e-mail database system.  To register, visit www.101thefox.net.  If the Grand Prize winner is not a registered Fox Fanatic, then the Station will randomly select the Bonus Prize winner from all Grand Prize qualifiers.  If it is determined that the candidate is not eligible to receive the Bonus Prize, in the Station’s sole judgment and discretion, another qualifier may be selected for eligibility consultation and this process will continue on until such time as an eligible qualifier is found. In the unlikely event that no qualifiers are found to meet the specifications, then the Bonus Prize will go un-awarded. In the event of a tie, the winner will be determined by and at the Station’s sole discretion.

8.       One (1) Grand Prize will be awarded. The Grand Prize consists of a 2010 Chevrolet Camaro. Prize vehicle may not be available for receipt at the Grand Prize Event; actual delivery date will be subject to dealer availability but in no event later than December 27, 2009. Winner must have valid driver’s license and auto insurance to claim the Grand Prize vehicle. Approximate retail value of Grand Prize is $22,000.

9.       One (1) Bonus Prize will be awarded. The Bonus Prize consists of a 1969 Chevrolet Camaro. Bonus Prize will be awarded in “as-is” condition with no warranty.   Winner must have valid driver’s license and auto insurance to claim the Grand Prize vehicle. Bonus Prize is valued at $30,000. 

10.    All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.

11.    All prizes are awarded “as is.” Prizes are non-transferable and cannot be exchanged, sold or redeemed for cash or other prizes.

12.    The Station and its parent companies and affiliates, members, directors, officers, employees, agents or representatives shall not be responsible for the failure of Promotional Sponsors to deliver the prizes or any part thereof as described herein.

13.    All entrants and winners agree that the Station and its parent companies and affiliates, the Promotional Sponsors, and their respective directors, officers, employees, agents and representatives shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the use or non-use of any prize received in connection with this Contest.

14.    All prizes must be claimed in person at the Station at the address identified above during regular business hours and within ten (10) business days of winning, excluding holidays. After such time, the winner then loses all claims and rights to said prize. Proper identification must be presented by any winner to claim prize. As a condition to receiving the prize, any potential winner must complete and sign a Winner’s Affidavit and Release, releasing the Station and its parent companies and affiliates, the Promotional Sponsors, and their respective directors, officers, and employees from all liability in connection with winner’s participation in the Contest, and his/her acceptance, use or non-use of the prize.

15.    All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of the Station to be used, disposed of or destroyed in its sole discretion. The Station is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Station’s website.   

16.    All entrants and winners agree to give the Station, its licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish his/her name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason the Station deems necessary without compensation, unless prohibited by law. All winners release, discharge, and agree to save harmless the Station and its parent companies and affiliates, directors, officers, employees, agents and representatives from any and all claims they may have against the Station in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live.  All winners further acknowledge that the Station owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to the Station.

17.    By participating in the Contest, each participant agrees to receive email communications from the Station regarding Station events and contests. Any participant that opts-out of these mailings will also remove themselves from the contest. By participating in the Contest, where allowed by law, participants agree that the Station may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes. 

18.    By participating in the Contest, participants agree to be bound by the decisions of Station personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Station’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Station, the Station reserves the right to terminate this Contest, or make such other decisions regarding the administration or outcome as the Station deems appropriate. All decisions will be made by the Station are final. The Station may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

19.    The Station reserves the right to limit the number of times an individual may enter a contest or drawing.

20.    The Station reserves the right to require contestants to be present at drawings in order to win their prize.

21.    A winners list may be obtained after July 1, 2009, by sending a self-addressed stamped envelope to the following address: 101 the Fox – KCFX, 5800 Foxridge Dr., 6^th Floor, Mission, KS 66202.
